 Last Night Discussion on Form-14 Verifications

Discussion with Mudassar Rizvi & Fawad was a bit technical but very important to current political crisis and negotiations. What we all need to understand is that the fundamental, the most necessary election record for verification is Statement of Count called Form-14. This Form-14 (Statement of Count) when filled completely details the: Total Registered Voters at the Polling Stations, Male Vote, Female Vote, Vote Cast, Vote Rejected and Total Accepted Vote. Form 15 & 16 prepared by Returning Officers (RO) that give the total result of a Constituency as to who has won is only a simple addition of all Form-14’s received from all Polling Stations.

Each Constituency of National Assembly in Pakistan consisted of anywhere from 250-300 Polling Stations. Each Polling Station was headed by a Presiding Officer designated by Election Commission. Who and who were appointed by Election Commission is an essential record; these were mostly officers of Education Department or Agriculture Dept. or such other provincial govt departments. Their “signatures” and “thumb impressions” are not only part of NADRA record but are also available from AGPR Office from where they draw their salaries.

Most Polling Stations have registered voters anywhere from 700 to 1500. So if Polling ends at 5pm, within 2-3 hours Form-14’s are ready for distribution to Polling Agents and onward deposit to the Returning Officers. At every Polling Station at the end of Voting, votes were counted within 2-3 hours supposedly in the presence of polling agents of several political parties. Presiding Officers by law issue Form-14 after signing on their names & titles, fixing their own thumb impression and writing CNIC. This constitutes a dully Filled Form-14. Form-14 is a Public Document; it should be put outside the Polling Station; may be given to Media and given the universal presence of new Camera software in every phone we can capture their photos for record.(Suggestion for Media and Election Monitors for Next Elections)

What Mudassar (FAFEN) was suggesting was that before a Judicial Commission or any JIT starts to go towards the Vote Count, the first basic steps should be done which will reveal a lot about the Elections and the next steps like Vote Count in Constituencies. The first basic steps should be to verify if Election Commission has all Form-14’s dully filled from all Polling Stations of all Constituencies. There should be around 69-70,000 Form-14’s for National Assembly and the same for Provincial Assemblies (since same Polling Stations were used) so around 138-139,000 Form-14s should be in possession of Election Commission. (ECP as per its own plan and commitment was supposed to put scanned copies of all these Form-14’s on its Website but for reasons not explained it has not been able to do it, which itself is a very suspicious act and raises very difficult questions)

Once ECP confirms the presence of duly filled Form-14’s, the next simple step is verification of the “thumb impressions” and signatures of the Presiding Officers on these Form-14’s. Since the record of the appointment of the Presiding Officers is available and their signatures and thumb impressions are part of record in NADRA and AGPR so it should take only 2-3 or at most 3-4 days of electronic work by NADRA to verify if the Form-14’s with ECP used for final Election Result are the same that were issued by designated Presiding Officers at the designated Polling Stations or they were changed at a later stage at the level of RO’s or DRO’s. It is important to understand that RO or DRO or ECP cannot change the Form-14 once issued without the Due Process of Law. Also keep in mind that large number of copies of the Form-14’s issued by Presiding Officers are available with PPP, PTI, PMLN, other parties, Election Monitors and Media and once these Form-14’s are made available on ECP’s website it is possible for public to check if the Form-14’s used by ECP for result calculation are the same that were issued by Presiding Officers in the evening of 11th May 2013 (Day of controversial Elections)

This is only one step; many follow through steps are possible. FAFEN may issue a press release which we will follow. What is the basic idea? The idea is that Election Investigations is a fact finding mathematical job; this is not a legal or constitutional task. Legal and Constitutional issues are very secondary or tertiary in this task. This explains why Election Tribunals are not of much help. Because in Election Tribunals allegations are being addressed or scrutinized as per law and procedure. Complainants are supposed to bring hard evidence of rigging which they often can not assemble on their own. And the issues keep on dragging. So Election Tribunals – the way they are working – have limited application to this challenge of fact finding and determination of what happened. For example whole Town may have seen a murder but in a Pakistani court room it may still not be possible to prove that who killed whom. Election Tribunals unfortunately, the way they are constituted, also fall in the same category.

This also explains why PTI & Govt Negotiations are not reaching anywhere. PTI wants Constituency records (30 or more Constituencies) and documents, votes etc to be checked and scrutinized which is simple common sense of “fact finding”. But PMLN & Allies term this as “Super Tribunals” and unconstitutional. When in his latest address to the concluding hours of Joint Parliamentary Session, PM Nawaz Sharif said that “we won’t accept any constitutional demands” he was not worried about his “resignation” he was referring also to this process of checking Election Results. What PMLN has been suggesting (when they say we have accepted Five Points) is that Judicial Commission should investigate allegations leveled by Imran Khan and PTI against RO’s, DRO’s, Iftikahar Chaudhry, Najam Sethi and ECP etc or allegations that PMLN was responsible for rigging through Interim Governments or that PMLN was the beneficiary. This is a legal trick, the kind of which is used by lawyers in courts to defend their clients. In terms of Investigations into the Elections, the basic Election Audit these are meaningless time wasting excuses and nothing else.

We hope these ideas, discussed in 19th Sept, 2014 ARY Special broadcast and this Facebook Note reaches all political parties and Siyasi Jirga and it may help them. We have not seen PTI Negotiations Team’s final and actual written suggestions handed over to PMLN & Allies in govt but we have seen the proposals by Siyasi Jirga of JI and PPP and Sisyasi Jirga proposals are definitely weak, ambiguous and wishy-washy. They don’t offer any mathematical result oriented Audit of the Elections. All political parties, media pundit and students of political science and Pakistan’s international stake holders need to realize that given the doubts and controversy around Election 2013, any next elections in Pakistan will be meaningless unless the nature of irregularities of Election-2013 are resolved and lessons learnt for Electoral Reform. Similarly Election Commissions recommendations today for Electoral Reform and Electronic Voting etc are another waste of time since Electronic Voting can be doubly dangerous without creating institutions of integrity and the Members of current Election Commission have lost their trust in public eye; they should just resign.

Elections are the only reliable instrument for a “Transition of Power” in a democracy. Future of Democracy in Pakistan is at threat not because of protests but because Elections-2013 are most controversial since 1977 and significant sections of Pakistani population have lost trust in that exercise and there won’t be any trust in a future elections without resolving these issues. – More later on this.

Poor Ex- Chief Justice of Pakistan is constructing a house of his own.

People of the country might have not forgotten what our worthy Ex- Chief Justice had said while entire Pakistan wanted probe into corrupt practices of his son Arslan Iftikhar, who defrauded a local businessman of almost half a billion of rupees, as being thought using the good office of his father, who happened to be the Chief Justice of Pakistan.
 
The honorable  Ex- Chief Justice sahib had said while hearing a suo-Moto case in the above referred matter, thought at that time by leading lawyers to have been taken to save his son, in the presence of full court that all through his carrier, being a salaried person, he could never save  enough to even build a house of his own over even One Kanal nor could till to date  own a car of his own.
 
 What a pitiable state of life for an honest poor salaried person of his stature. Of course, he was very right to express his inability to own such things within limited income as a  salaried person. Very True.
 
However, now after a passage of around two years, an exciting but worth pondering news, out of blue, using his magic wand,  then Poor Chief Justice, now EX-CHIEF JUSTICE of Pakistan is very conveniently constructing a Palatial House on a plot measuring 12 Kanals in Cantonment area of Lahore, a Posh Residential Area, where the cost of land is only  Rupees 30 Crore. 
 
The construction of said palatial house, having covered area of around 18000 sft, is in full swing, the insiders have revealed that the said house is being constructed at a cost of RS. 7000/sft. The over all cost of works, including landscaping etc, etc is around RS 15 Crore. Noteable, the cost of interior works is beside the said amount, which is yet to be carried out, duly being designed by one of the top interior designers of the country.
 
For sure, what else a poor honest salaried Ex-Judge of Pakistan cannot do anything more than what is now been seen on the ground.

An account of Iftikhar Cuaudhry’s Brilliant Career

Our memories are short but not that short particularly with respect to Justice Iftikhar Muhammad Chaudhry:

Oath on PCO 1999
1. In January 2000, Justice Iftikhar Chaudhry, then a serving judge on the Balochistan High Court (BHC), was one of the first judges to take the oath on the Provisional Constitutional Order (PCO) of the military dictator General Musharraf in violation of Pakistan’s constitution. This allowed him to be elevated to the Supreme Court to fill one of the vacancies left by the 11 judges who had resigned in protest at taking this oath.

2. On May 13, 2000, Justice Iftikhar Chaudhry was one of the 12 Supreme Court judges who validated the military coup of Gen Pervez Musharraf. They ruled that the removal of the elected government of Nawaz Sharif was legal on the basis of the ‘doctrine of necessity’.

3. In June 2001, Justice Iftikhar Chaudhry was one of two judges who visited the President House to convince the then President Rafiq Tarrar to resign, and make way for Gen Pervez Musharraf to assume that office.

In a wide ranging judgment they declared that the Legal Framework Order (LFO) instituted by General Musharraf after his suspension of the Constitution, the 17th Amendment which gave this constitutional backing, and the two offices bill which allowed Musharraf to retain his military uniform whilst being President were all legal.

Selective judgement on PCO judges

Constitution Petition Regarding PCO Judges:
The decision of the court in CONSTITUTION PETITION NO. 08 and 09 OF 2009 from 14 member bench headed by Iftikhar Muhammad Chaudhry, summarily removed all justices of higher judiciary who were not part of it as on November 2, 2007. There removal was so ordered on ground that advice of de-jure Chief Justice of Supreme Pakistan was not obtained in these cases. In the same decision the court had held the de-jure Chief Justice between the period of November 3, 2007 and March 22, 2009 was Justice Chaudhry.

There were three groups of these removed justices.

  • Those who were elevated to higher courts and initially took oath on PCO.
  • Those who were elevated to higher courts after restoration of constitution, and were appointed by General Pervez Musharraf.
  • Those who were elevated to higher courts after restoration of constitution, and were appointed by Asif Ali Zardari.

This decision have resulted in situation where:

  • Newly appointed justices who never took any sort of oath on any PCO have been removed.
  • Sitting justices who took oath on PCO 2007 are still acting as justices, though their cases are to be sent to Supreme Judicial Council.
  • Sitting justices who accepted reappointed and took oath from Justice Dogar as still acting as justices of court with no action.
  • Justices who took oath on PCO of 1999 are still functioning as justices of higher judiciary.

ARSALAN IFTIKHAR CASE: ASMA QUESTIONS SUDDLE’S APPOINTMENT

LAHORE: Leading human rights lawyer Asma Jahangir on Monday raised questions about the role of the Supreme Court regarding Dr Arsalan Iftikhar’s case.

Asma, a former president of the Supreme Court Bar Association (SCBA), also suggested inviting a Scotland Yard (metonym for the headquarters of the Metropolitan Police Service of London) team to probe the case if the country’s institutions were not deemed trustworthy by the judiciary.

Talking to reporters at the Lahore High Court premises, Asma alleged the court was not meeting the requirements of delivering justice in the case against Arsalan in the Bahria Town scandal. She also rejected the appointment of Federal Tax Ombudsman Dr Mohammad Shoaib Suddle, the officer tasked by the apex court to investigate the case, after it barred the National Accountability Bureau (NAB) from investigating the matter.  She alleged that the apex court wanted to influence the investigations, as Suddle is said to have close links with Arsalan.

“The Supreme Court should ask the Scotland Yard to conduct the investigation into Arsalan Iftikhar’s case, if it has no confidence in the national institutions,” she said. Asma pointed out that Suddle also regularly accompanied Arsalan at various events. Therefore, he could not be expected to conduct a transparent investigation into the case.

Asma said Arsalan should, however, be given the benefit of the doubt. But she also reiterated that everyone should be treated equally under the law.

Criticising the court, she said if there were any questions over the NAB’s investigation team, then it could have been changed instead of forming a new inquiry team.

 

 

CJ GATE: INNOCENT CHAUDHRY, GUILTY DOGAR AND GREAT PAKISTANI REPTILIAN ANSAR ABBASI – BY RAZA BALOCH

 

We mostly watched out for each other especially when it came to mangling the Constitution in favour of the 3-Jeem alliance

First great Pakistani reptilian man Ansar Abbasi most probably is inspired of Bollywood’s super hero film “Shahanshah” released in 1988. Ansar Abbasi Shahanshah of Islamic Umma played the role of Shahnshah in Chief Justice Abdul Hamid Dogar’s court and unveiled a scandal against Chief Justice Dogar by using his daughter Farah Hameed’s “marks issue” after a very conclusive investigation in 2008. Ansar Abbasi challenged the Chief Justice of Pakistan and threatened Farah Hameed by a dialogue “Rishtay mein to hum tumhary uncle lagtay hein magar nam hay hammara Shahanshah Ansar” and by singing a song “Roshan raaton mein abaad raahon par / har zulm mitaane ko ek Mulla nikalta hai jise log shahenshah Ansar kehte hain”.

Personally I really appreciated Ansar Abbasi’s artistic reptilian stature. His hair style, eyes, beard and face make up, all very similar but fiercer than Amitabh Bachan while attached a corrupt and sniveling bank manager Mathur and crime tycoon JK. Though Ansar’s height is about half to Amitabh but he acted well in super hit Shahanshah Ansar 2008 film and unveiled CJ Dogar’s corruption and use of power in getting some marks for his daugther in FSc examination. Our Shahanshah Ansar after that film has acted as hero or side hero in many films but after Chief of Chaudhries CoC Justice Iftkhar Chaudry regained his throne with the assistance of establishment, Ansar was assigned to defend the CoC’s Supreme League of Pakistan (SLOP).

CoC Iftikhar Chaudhry was compelled to open a closed gate aka the Mehran Gate after PML (N) opened a new gate called Memo Gate and then CoC’s legendary son Arsalan Iftakhar Choudhry opened third gate The CJ Gate and we know the heaven had seven gates so there are still four more gates to be opened. CoC acted well even better than Shahanshah Ansar and proved to be Shahanshah Akbar or Dilip Kumar in Mughal-e-Azam by taking suo moto against his son Arslan alias Shahzada Saleem alleged in long drive with Anarkali in London. Here in Lollywood’s Iftakhar-e-Azam Jodha Bai (Mrs CJ Chaudhry) was alleged to be accompanying Shahzada Saleem in shopping and staying in luxurious apartments in London. CoC Iftakhar-e-Azam has barred Shahazda Saleem from seeing her mother. “My father has told me I don’t need to return home nor make any contact with the family members,” Dr. Arsalan said. SLOP is made responsible by CoC to find out Anarkali of Iftakhar-e-Azam film and ordered to entomb her alive in a brick wall.

During this entire episode, many torchbearers of the supremacy and independence of Judiciary are playing their roles but Shahanshah Ansar is playing well and proved that SLOP or CoC (CJ Iftikhar Chaudhry) is not guilty of his son’s crime, that his innocent son was trapped and blackmailed by enemies of independent judiciary.

CoC wanted to decide this case according to verses in the Quran but not legal code of conduct. He saw no conflict of interest to head the bench, perhaps to chastise Arslan that why he did not invite the CoC to bea  part of new Lollywood film “The CJ Gate” during shooting time in London.

CJ’s statement on oath that he swears on God that he had no knolwedge regarding shooting of the movie and Arslan’s business trips to London. CoC’s left eye was full of tears while he told in an open court that Arslan never had paid any penny to him or his mother and never had purchased even a few potatoes and beans for kitchen. “Arslan never bought suit for me even on Bakra Eid and he never offered me or his mother to pay for our Hajj expenses. Despite that I never taunted him for his luxurious London trip because he at least provided me with a lonely life in my home for a few months.”

CJ clearly told the open court that he trusts SLOP (Supreme League of Pakistan) and its second tier leader Justice Jawad Khwaja who is likely to solve the “The CJ Family Gate” issue politically by dialogues with elite business friends, journalists and lawyers. And if Arslan is found guilty he will be stoned in front of Anarkali and Anarkali will be cemented alive in a brick wall of the Independent Judicial Complex in Islamabad

In the meanwhile, kudos to great Pakistani Reptilian Ansar Abbasi who had proved Chief Justice Dogar as guilty of his daughter’s “crime” in 2008 and now in 2012 he has proved CJ Iftikhar Chaudhry as innocent of his son’s multi-millions business deals with Malik Riaz.http://www.geo.tv/GeoDetail.aspx?ID=53220

Of course, keep in mind that there are at least four more gates are awaiting to be opened!

PAKISTANI PRESIDENT ASIF ALI ZARDARI’S PRIVATE VILLA IS BLAST-PROOF, HAS RUNWAY

Lahore: A sprawling high-security private residence for Pakistani President Asif Ali Zardari, complete with bomb-proof structures and a landing strip for small jets and helicopters, is nearing completion here. The compound in Bahria town, spread over some 200 kanals (25 acres), is named Bilawal House after Zardari’s son Bilawal Bhutto Zardari. According to a Pakistan Peoples Party official from Punjab the residence has been gifted by property tycoon Malik Riaz Hussain.
 
The bomb-proof home is surrounded by lawns that can accommodate up to 10,000 people and has a runway for private jets and helicopters. The compound is surrounded by 30-feet high walls fitted with security gadgets. Once completed, the residence will have a three-tier security system. Zardari, who is due to arrive in Lahore on Sunday, is expected to visit Bilawal House with his son, the sources said. The residence in Lahore will serve as the main base in Punjab province for Bilawal during campaigning for the upcoming general election. Malik Riaz Hussain, believed to be close to Zardari, was at the centre of a controversy last year after he alleged that he funded three foreign trips by Arsalan Iftikhar, the son of supreme court chief justice Iftikhar Chaudhry.
 
Meanwhile, on the president’s arrival, the private security guards of Bahria Town hosed water through high-pressure vehicles to disperse the journalists who tried to enter the housing society to cover the event. Some of the journalists received injuries. The Pakistan Federal Union of Journalists, Lahore Press Club leaders and the journalist community have strongly condemned the guards’ misbehaviour with the journalists and demanded legal action against them.

SDPI report: 58.7m Pakistanis living below poverty line

Highest incidence of poverty prevails in Balochistan with 52% of the households living under poverty threshold.

As many as 58.7 million people in Pakistan are living in multidimensional poverty with 46 per cent of rural population and 18 per cent of urban households falling below the poverty line, says a survey report.
The report titled ‘Clustered Deprivation’ is prepared by the Sustainable Development Policy Institute (SDPI) with the financial and technical assistance of United Nation Development Program (UNDP).
The SDPI measures poverty on the basis of five dimensions – education, health, water supply and sanitation, household assets/amenities and satisfaction to service delivery. Further, a person taking less than 2,350 calories per day and earning less than $1.25 per day according to the United Nations standard has also been regarded as living below the poverty threshold.
The highest incidence of poverty prevails in Balochistan with 52 per cent of the households living under the poverty line, followed by 32 per cent, 33 per cent and 19 per cent respectively in Khyber Pakhtunkhwa (K-P), Sindh and Punjab, said the report presented to all provincial governments during the last month of 2013
In Punjab, higher incidence of poverty was observed in southern districts. Rajanpur is on top of the list with 44 per cent households falling below the poverty line.
The people living below the line in other southern districts respectively comprise 40 per cent households in Muzaffargarh, 36 per cent in DG Khan, 33 per cent in Bahawalpur, 31 per cent in Layyah and Lodhran, 31 per cent in Pakpattan, and 28 per cent in Multan, Khanewal and Bhakkar districts.
The SDPI report on Balochistan says the restive province faces the highest incidence of poverty as compared to others. However, except for Muskhel, the majority of the districts in the north have relatively low incidence of poverty. It is high in the central and southwest part of the province with the exception of Panjgur and Gawadar districts.
In K-P, the incidence of poverty is extremely high in the northern mountainous regions, very high in the southern regions, average in the central parts while the districts adjacent to Islamabad show low levels of poverty.
According to the document, the southeast part of Sindh is the poorest region, while central Sindh is relatively less poor and southwest Sindh the least poor region of the province. Out of 27 districts, the inhabitants of 18 districts are facing severe poverty conditions.
Tharparkar has the highest incidence of poverty in Sindh with 47 per cent households living below the poverty line. The report says 42 per cent households in Badin, 41 per cent in Tando Muhammad Khan, 40 in Thatta, 39 per cent in Nawabshah and Jamshoro, 38 per cent in Larkana and Shahdadkot, 36 per cent in Jacobabad, 32 per cent in Tando Allah Yar, 29 per cent in Matiari and Dadu, 28 per cent in Shikarpur and Sanghar, 27 per cent in Khairpur, and 25 in Hyderabad and Sukkar districts live below the poverty threshold.
The report reveals that one-third of Pakistani households are facing poverty, with uneven distribution mong provinces and rural and urban populations. With more than half of the population below the poverty line, Balochistan is the poorest province.
Acknowledging the SDPI report, Punjab Planning and Development Board chief Khalid Sultan said it had used the report had used data from Pakistan Social and Living Standards Measurement Survey (PSLM) that is specifically designed for the analysis of poverty.

The Sharif brothers and their closest confidante Khawaja Mohd Asif are all set to squander away an astronomical sum of 3 Billion Us Dollars.which will put to shame all scammers in the past such as Mr 10 Percent and his cronies…All other scandals such as Swiss accounts OGRA Hajj Ephedrine scams will be dwarfed if the script is executed.
 
The series of China visits by Sharif Brothers and their children, Khawaja Asif and a Lahore based tycoon ,are nothing but part of the grand design of the mega of the mega scams…
 
The Sharif brothers have struck deal with Some Chinese coal power companies to inflate the officially notified tariff and capital cost of power projects by a whopping 3 Billion dollars to accommodate their kick backs. The 6600 MW Gaddani coal power park and planned 6600 MW coal power projects are the crux of the deal combining into a total of 13200 MW. The main architect of the scam is Khawaja Mohd Asif who interestingly had challenged the rental power plants in Supreme court and a favorite of former CJP Mr Iftikhar Chaudhry.
 
He is actively assisted in this wheeling dealing by Salman Shehbaz younger son of Punjab CM and active participant in bilateral govt dialogues between Govt of Pakistan and China despite the fact that he does not hold any public office.
 
Sharif brothers who have a penchant for flouting rules or bending them to pave way for their grandiose corruption have established a nexus with Acting Secretary Water and Power Mr Saifulla Chattha ,Ms Nargis Sethi CEO of Gaddani Power Park on one hand and looking after all important Economic Affairs Division. This division is responsible for approval of all financing agreements with Chinese companies and export credit agencies such as EXIM Bank, China Development Bank etc .

for whiplashing non compliant officials. The final actor in the script is Kh Mohd Naeem present acting 
 
Chairman NEPRA and a brother in law of Khawaja Mohd Asif and father of PML N woman MNA Shaza Fatima.
 
THE PLAN
The plan of this scam has NEPRA as the main instrument. Since it is power sector regulator therefore it has its mandate to determine power tariff, key benchmarks such as capital cost of power projects, plant efficiency, issuance of tariff and other critical standards which have key influence on level of consumer prices and consequently corrupt practices. The equation of corruption has two critical variables namely Capital cost and consequently Tariff. Higher the capital cost the more the consumer has to pay over the term of agreement.(as simple as that…these Sharif Brothers and Khawaja will claim that it is still cheaper than Oil based costs BUT the fact remains that it is much more expensive than it should be)
 
The key to Sharif brothers plan is in capital cost of coal power projects. And the citizens of Pakistan will bear the brunt of this corruption in coming years.
 
The road to achieve this has been paved by Khawaja Mohd Asif who has moved a summary to NEPRA through his secretary Water and Power to reopen the upfront TARIFF already determined by NEPRA in JUNE 2013after a very lengthy process of consultation with stake holders and public hearings and formally notified in Sept 2013.Any one including Ministry of Water and Power could have represented against determination of NEPRA within fifteen days, which have long expired. The Secretary has asked NEPRA to condone the 15 day period by relaxing Section 31 of NEPRA Act. NEPRA instead of out rightly rejecting this illegal demand has fixed the case for public hearing.
 
The already notified NEPRA tariff and capital cost are very generous and already 25% above the internationally available data on capital cost. This NEPRA claims was done to attract investors for a period of 6 years ending 2019.In fact foul play was also done in Sept 2013 when capital costs for a 600 MW coal power plant were increased from 585 million dollars to 1.25 billion US Dollars. The tariffs notified in Sept 2013 for plants based on imported coal were……..cents per unit.
 
Now in collusion with Chinese companies the Sharif brothers cleverly playing Energy and China cards are clamoring to get these costs heavily increased and rules set aside to skim off 3 billion dollars over and above NEPRA determined price and 6 billion dollars over and above international bench marks.
 
The Ministry of Water and Power are hell bent to accomplish following goals
 
• To increase the capital cost by another 29% from 1.25 Million Dollars per Mega Watt to 1.5 to 1.7 Million Dollars per Mega Watt for 600 and 200 MW plants respectively.
 
• To increase tariff from the notified tariff by 41% to 65 paisa per unit for 600 MW plant and 40 % to 60 paisa per unit.
 
• To reduce plant efficiency factor for 600 and 1000 MW plants from approved 42% to 39 %
 
• To change PPRA rules to exempt Chinese companies from Procurement procedures and competition
 
• To Delete two (660×2) coal power projects At Gaddani from the Govt execution list and also hand them to private sector on the pretext of shortage of govt funds. In reality the reason is that if these projects are implemented by govt then it will have to follow PPRA Rules and announce competitive bidding which will expose real costs of these projects.
 
INTERNATIONAL EXAMPLES of COSTS
 
In January 2014, South Korea’s state utility KOSEP executed an agreement with an Indian company Jinbhuvish Power Generation to set up a 600 MW coal power plant in Yavatmal,Maharashtra a cost of 585 Million US Dollars translating into 0.91 Million US Dollars per MW .
 
• Similarly The Indian Government owned NTPC is setting up indigenous coal based (more expensive compared to imported coal due to mining costs) ……2640 MW plant in Bundelkhand Madhya Pardesh consisting of 4 Units ( 660 x4) at a cost of 2.9 billion US Dollars translating into 1.09 Million dollars per MW. It is well in knowledge of Mr Shehbaz Sharif but they are notorious for inflating project costs to skim off money. Examples are Metro project in Lahore and now in Rawalpindi at grossly inflated prices.
 
THE MATH of Corruption
 
Taking into account the planed implementation of a total of 13200 MW coal based power projects for which MOUs have already been executed ,the total amount of money to be looted is 13200x 0.25 million US Dollars translates to a very conservative 3.3 Billion US Dollars. In reality Chinese companies stand to make another extra 3 BILLION DOLARS.
 
The scheme so cleverly designed will enable the Chinese companies to set up the plants for free without putting a dollar of their own. The method is simple: Given the 75:25 ratio of Debt and Equity for these projects, the Chinese companies will put in 25 percent equity( already over priced by 25% over and above world prices) and 75% bank loans sovereign guaranteed by Govt of Pakistan. The interest cost will be recovered from consumers. So 25 % being the kick back, the Chinese companies will be setting up the plant for free. Whereas Sharifs and Khawaja will be skimming the remaining 3+ Billion dollars
 
THE WAY FORWARD
 
To save the nation from this mother of all corruption it is imperative to launch a nationwide campaign through media, patriotic legislators politicians, professionals and also Supreme Court to demand an independent estimation of actual costs..otherwise Sharif Brothers and Khawaja Asif will again plunder national wealth .

No doubt, favorite system of governance in the Western countries is democracy. By using their legitimate right of vote, people participate in political process, and elect their own representatives to govern them. Thus, they give mandate by authorizing the elected members to hold public offices and make legitimate decisions to run the affairs of state. And, the elected representatives remain accountable for their actions, while, the system of electoral democracy also empowers the voters to take away the powers of the elected members, if they fall short of popular aspirations—good governance, solution of public problems and so on.

 

In case of Pakistan’s version of democracy, it has the same system of representatives according to the constitution, but the elected representatives grossly violate the public mandate for obtaining their selfish and materialistic gains. Regrettably, voters, after having elected their representatives, virtually become subjects of powerful elite who tend to shatter all hopes of voters by neglecting their social problems, financial difficulties and psychological distress. Promises made during election campaign are quickly forgotten, while perks of public offices are fully enjoyed. Irony of the fate is that same elite group gets elected over and over again and election campaigns are held as rituals. Unfortunately, voters, due to their extreme poverty and poignant standing lack social influence and political power, becoming trading pawns in the hands of politicians who regard elections as windows of business opening to plunder national wealth through all possible means of corruption whose result is poor governance.

 

Most of the elected representatives in National Assembly and Senate hardly make any worthwhile contribution, as they remain absent during active sessions of the parliament. Therefore, sessions of the lower and upper houses are adjourned due to lack of quorum, and the process of essentially required legislation remains blank and weary. Resultantly, the voters’ aspirations turn into hopeless ordeal, dejection and despondency.

 

It is notable that various mal-practices such as horse-trading, nepotism, bribery, illegal obligations and other forms of corruption are very common among our politicians. In fact, the elite group of elected members uses powers of their public offices to advance their personal interests including engagement in politics of THANA and KUCHHERY (Police and Court), earnestly seeking allotment of development and discretion funds and timely steps of sycophancy to please the top party leaders. Poor educational background makes them inactive and soundless during debate sessions to approve or reject key issues, requiring parliamentary endorsement. They also remain oblivious of world politics and philosophical aspirations of great leaders like Nelson Mandela. Thus, they promote their personal interests, and show total callousness towards torment of their voters.

 

Undoubtedly, in Pakistan, corruption is a significant obstacle for good governance, supremacy of law, and rational use of authority to run the affairs of state and to maintain public cohesion and national harmony. Unfortunately, corrupt practices and misuse of public office lead to general frustration, opening windows of protest with sense of dissent, disapproval and conflict against the governing authority. The environment of agitation and demonstrations carry seeds of large scale disturbances, creating law and order situation, social disorder and political chaos, culminating in poor governance. In a real democratic system, hence, wise rulers undertake tangible measures to fight corruption with a view to improve governance and maintain order.       

 

It is our misfortune that rampant corruption in the country has infected the entire edifice of national institutions, while the rule of law appears to have been totally disregarded. Consequently few parasites devouringly consume best of resources, while the poor majority remains repressed and victimized under hard economic conditions.

 

The elite leadership despite having been empowered by the masses through a democratic process has developed vicious aversion, disgusting dislike, malicious vindictiveness and insensitivity against general public, they actually represent.

 

Political leadership is busy in power grabbing process, while the poor suffer under hard environment where healthy food, clean drinking water, respectable shelter, justice, education and health care facilities are totally non-existent.

 

In this regard, the ordeal of poor in Pakistan can well be anticipated by prevailing un-employment, poor living and health conditions, price hike, social injustice, contempt for merit, promoting cronyism, and poor law and order situation in the country.

 

Regrettably, the concerned ministers remain busy in settling scores against their political rivals, using floor of parliament and media channels. Most of their time and effort is spent on preparing fierce speeches to level fresh tirades of accusations and counter allegations.

 

The poor voters remain bewildered as protesting groups, PAT and PTI make noises in sit-ins, at Islamabad, pointing out corruption of subsequent rulers of the PPP and the present ones of the PML (N), as to what they have done under the cover of democracy. While ruling elite and their associates in opposition benches of the parliament have termed the protests as unlawful, unconstitutional and undemocratic.

 

Besides, political leaders enraged outbursts, filled with allegations and counter accusations. Some of them, especially of the PPP and PML (N) have shamefully tried their best to drag the Armed Forces into political turmoil. They have brazenly accused Pak Army and country’s prime intelligence agency, ISI (without any evidence) for orchestrating the prevailing political impasse which was created by the politicians themselves.

 

On the other side, through various statements, DG of ISPR Maj-Gen. Asim Bajwa repeatedly said, “Pakistan Army supports democracy and constitution.” He elaborated, “The army chief in his address on Youm-i-Shuhuda (Martyrs’ Day) clearly said that the army believes in continuation and democracy.”

 

However, these parliamentarians and leaders have disregarded the commitment and sacrifices, being offered by the Armed Forces in the operation Zarb-e-Azb and flood relief operation. All the patriot citizens of Pakistan know that for the last few months, Pakistan’s Armed Forces are successfully obtaining their objectives in North Waziristan Agency (NWA) through this military operation against the terrorists who had challenged the writ of the state, and had frightened the entire nation by their terror-acts. The Armed Forces are also engaged in rescue-operations in the flood-affected areas. Besides, Pak Army has also been coping with subversive activities in Balochistan, Khyber Pakhtunkhwa, and other parts of the country including tribal areas in wake of India’s war-like diplomacy and cross-border infiltration from Afghanistan’s side.

 

In fact, under the cover of democracy and constitution, some politicians of the government and the opposition parties who want to protect their nefarious designs are targeting the Armed Forces. Thus, they are diverting the attention of the general masses from those articles of the constitution, which are mentioned in the ‘Principles of Policy.’ These articles clearly mention that people would provide with justice, gap between the rich and the poor would be reduced, and poverty would be eradicated in the country. However, our politicians and the subsequent governments of the industrialists and feudlords failed in delivering good governance to the people in accordance with the constitution. They have only deceived the public mandate in the pretext of democracy which has been named as a ‘corrupt democracy’ in Pakistan.

 

No doubt, Pak Army is supportive of democracy and is committed to protect the constitution of Pakistan. But, leveling derogatory allegations against Army is a serious crime, and it must not be allowed to recur under any circumstances. Army as an institution cannot be made a punching bag—subjected to public debate.

 

Now, the right hour has come that the political leadership must conduct introspective analysis of their style of governance, and must develop a desire to fight the menace of corruption through accountability and transparency. The aim should be to put the house in order.

 

As already mentioned that rule of law seems non-existent, while merit is totally disregarded. Cronyism and nepotism are fast-spreading, setting unethical precedence and bringing bad name to governance. The public perceptions are getting stronger that poor governance is due to corrupt practices and misuse of public office. The same needs to be addressed on priority. So, leadership must prepare a strategy to address the problems of general masses and stop fighting for acquiring more power, and practicing corruption. 

 

Particularly, our own media must project corruption as a threat to good governance which must be fought through transparent and accountable practices. 

 

Nonetheless, rampant corruption in Pakistan is posing a very serious threat to the state as well the true democracy. It has become a significant obstacle towards development, and adversely impacting the good governance and rule of law, culminating in poor governance.

Ishaq Dar is highly regarded for his financial expertise and has twice served as federal minister for finance, economic affairs, revenue and statistics. Considered a PML-N stalwart, he has headed the party’s international affairs office since 2002. Apart from being elected an MNA thrice, Dar has been elected Senator three times along with being appointed as PML-N’s parliamentary leader in the upper house each time.

In February 2014 in Dubai on an official visit as Finance Minister of Pakistan again, he said “We inherited three bad ‘Es’ — bad economy, energy and extremism — from the previous government but we have managed to control the situation within seven months since we took over last year.”

He announced that Pakistan was open for business once again but it seems more likely he was expanding his own business. Surreptitiously, on the sidelines, Ishaq Dar has built himself a business empire, reportedly managed by his two sons Hasnain Dar and Ali Dar. HDS Tower in Cluster F of Jumeirah Lakes Tower is only one of the 34 story buildings that belong to the mighty HDS Group. Several other buildings in Jumeirah Lakes Towers, Business Bay and International City, like the HDS Sunstar Towers, are also owned by the millionaire brothers.

The owners of HDS Group, Ali Dar and Hasnain Dar manage everything perfectly for Ishaq Dar. It’s worth mentioning here that the elder son Ali Dar is also the son-in-law of Mian Nawaz Sharif. Real estate business and development is the main concentration of the HDS group, moreover owning various commercial and residential towers in JLT, Business Bay and Central Business District of International City in Dubai.

The HDS Group flagship project has 2 million sq feet built up area and is currently under construction in the Burj Khalifa area, this project alone is a millions of dirhams worth. Such projects make this group one of the foremost property developers in UAE.  The group even survived the economic downfall of 2008 .

Reportedly, Bahria Town Dubai office is located at the top floor of JLT Business Towers owned by HDS. It is rumored that some space has also been kept free for a future office for Asif Ali Zardari, ex President of Pakistan. Recently, Ishaq Dar introduced his sons to the ruling family and top authorities of UAE for propagation of future business interests on an official visit there.

Here is a list of the main assets owned by HDS Group:

1.HDS Tower, a 39 storey commercial and retail tower located in the F cluster of Jumeirah Lakes Towers was constructed in 2008, the tower consists of small, medium and large apartments and offices. Its monetary worth is billions of dirhams.

3.HDS Sunstar 1 and 2 is a 10 storey residential building in the central business district of International City, Dubai.Luxury rooftop swimming pools and gymnasium assured rental of the 120 apartments within a month of its completion, this project is also priced at billions of dollars.

4.Sobha Ivory 1 and 2 is in the heart of Business Bay, UAE s prime business location. This property has easy access from Sheikh Zayed Road and is one of the most wanted business addresses in Dubai.

5.Take a Break is a semi serviced coffee shop on the ground floor of HDS Tower in Jumeirah Lakes Towers launched in December 2011.

6.HDS Mini Golf was launced in the end of 2013, the chief guest was H.E .Ahmed bin Sulayman. It is an entertainment hotspot located at Lake Level of HDS Business Tower in cluster M of Jumeirah Lakes Towers.

7.HDS Owners Association Management Company is a licensed facilities management company.

8.HDS Rent a Car is one of the first rent a car companies in the Middle East to launch the exotic Lamborghini Avebtador LP 700 and the 2013 Mercedes Benz G63 in the rent a car industry .They also provide the finest Rolls Royce Phantom, Ferrari, Lamborghini, Bentley, May Bech, ,Mercedes Benz and BMW. The owners are offering such exotic services in Dubai, which even the local Emiratis fail to afford. Ishaq Dar made hundreds of real estate transactions with Madhu Bhindari, an Indian billionaire entrepreneur, who is on a run from Dubai, after losing 150 million dirhams in the 2008 crisis. However, the finance minister’s buildings and investments are still earning him a hefty income.

A Pakistani real estate agent related how a lot of Pakistani bureaucrats and politicians have properties worth millions in Dubai. “The son of a serving government officer from Sindh government invested a huge amount of money in real estate here in 2008, and I carried out transactions for him,” the agent claimed.

“Where are these politicians getting the money from?” asked a Pakistani in Dubai, who came to know that the building he lived in is owned by Ali and Hasnain Dar’s HDS Group.

“If they have billions of dollars and so much money, why is it not in Pakistan?

These politicians talk about the welfare of Pakistani people, but all they can think about is themselves!”

Director Swiss Bank had stated some years back that Pakistan has around 97 billion dollars only in Swiss Banks. But the reality is that Pakistani politicians and businessmen have much more than 97 billion dollars outside Swiss Banks, invested in various countries and financial centres like Dubai. According to the Swiss Bank director, if the money is spent on Pakistan and its people, then Pakistan could have a tax free budget for next 30 years, it could create 60 million jobs, could carpet four lanes road from any village to Islamabad, provide endless power supply, every citizen could get a Rs. 20,000 salary for the next 60 years and there would be no need to take loans from IMF or the World Bank.
