The hypocrisy of India and Indians has been exposed to Americans as an aftermath of H-1B Visa Scandals in the US. Americans are beginning to learn that Indians take short cuts to beat the American system. If one qualified Gujarati IT person comes to Silicon Valley Company, rest assorted, hordes of Visa scammers would follow. US Justice Department has wised up to these scammers and US Consulate in Mumbai has become quite savvy in identifying an IT scam.

The Indian tech worker H-1B visa scam

More than 1 in 3 US tech jobs go to foreigners. Americans, and many foreigners, get cheated in the process. Obama and Zuckerberg want to let in more.

NEW DELHI, India — When news about an American company hiring Americans gets widespread coverage in India, there’s clearly something unusual going on.

So why would Indian newspapersTV stations and financial websites be interested — arguably more interested than most US media — in the announcement by New Jersey-based IT firm Cognizant Technology Solutions that it will create 10,000 new American jobs?

The short answer is that most of Cognizant’s 166,400 staff is based in India. Only 29,000 work in the US, mostly at the firm’s headquarters in Teaneck, NJ.

Cognizant is a major player in the global outsourcing industry, and India is the world’s outsourcing hub. But most of its revenues come from the US.

In its most recent quarter, the company reported earning $1.78 billion in the US, boosted by “Obamacare.” Insurers and states hired Cognizant to help code online insurance exchanges.

For many Indian techies, working for a company like Cognizant is a chance for a US transfer and a slice of the American dream.

And those 10,000 new American jobs that got so much Indian media attention may mean 10,000 fewer jobs for them.

Outsourcing giants

The US Congress created the H-1B visa program to enable American companies to hire foreigners with exceptional skills. Instead, critics say, it is increasingly being used to find workers willing to accept lower salaries. The program allows up to 65,000 high-skilled foreign workers to work in the US for up to three years. Competition is intense: The visas are handed out on a first come, first served basis and it took just four days for the 2014 quota to be filled after it opened on April 1, 2013.

Most come from India — 64 percent of last year’s applicants, according to the White House. Four Indian firms — Cognizant, Infosys, Tata Consultancy Services and Wipro — brought more than 26,000 Indians to work in the US in 2012 under the H-1B visa scheme, according to research bProfessor Ron Hira, of the Rochester Institute of Technology.

Getting an H-1B visa has become a major career step for many IT graduates, and a major source of profit for the outsourcers.
For Indian workers, a job in the US means opportunities and money. For the outsourcing firms, the Indian IT workers are significantly cheaper than their American counterparts — by about 25 percent.

Tech companies have been lobbying to increase the cap — Facebook founder Mark Zuckerberg set up pressure group FWD.us to campaign on immigration issues. Microsoft founder Bill Gates has been a long-time advocate of making it easier for foreign-born high-skilled workers to immigrate.

“Since these [outsourcing] companies depend on the program so heavily they flood in applications,” Professor Hira told GlobalPost.

“The firms ‘bank’ visas — keep people back in India on the bench and then utilize them when needed. Also, they rotate workers in the US to ensure they don’t establish roots, and rotate them back and forth to India. These firms are growing so fast that they need a bank of visas to meet any new growth.”

Scammers abound

In the face of such intense competition, companies have been tempted to break the rules.

In October, Infosys paid a $34 million settlement to the Federal Government — a record for an immigration case — over allegations of “systematic visa fraud and abuse of immigration processes.”

Unable to get its cheaper Indian employees to the US to work on short-term contracts, Infosys used a different visa — the B-1, normally given to foreign businessmen who need to travel to the US to complete deals.

According to an official from the Department of State’s Diplomatic Security Service, special agents spent two and a half years examining the records of 6,500 foreign Infosys employees on B-1 visas.

“Instead of attending ‘business meetings and discussions’ … many of these individuals … were working for Infosys in the United States, in violation of the conditions of their B-1 visas,” the official told GlobalPost via email.

Infosys employees were even given lists of words and topics to avoid when applying for the B-1 visas, including “implementation, design & testing, consulting” and “work, activity.”  

The official was unable to comment on “ongoing investigations” but said the department wanted to “raise awareness about how the visa process is being circumvented.”

There are several other recent cases.

In October, IBM, the seventh largest H-1B visa user, paid a $44,400 civil penalty for favoring foreign H-1B workers over US citizens.

In addition to these cases, which cost US workers’ jobs, US officials have been forced to defend the foreign employees from exploitation by the outsourcing firms.

In February 2013, Mumbai-based Tata Consultancy Services paid a $30 million settlement over its practice of forcing employees to sign over their tax refund checks when they finished working in the US.

There is an ongoing case involving 18 American IT workers who claim they were laid off from their jobs at Molina healthcare in Long Beach, California, to be replaced by Indian workers hired by Cognizant.

American lose jobs and wages

Despite these abuses, the IT industry says too few graduates come out of American universities to meet demand for jobs.

President Obama backed a bill passed in the Senate in early December, which would increase the 65,000 cap on H-1B visas to 115,000.

Yet several researchers say their work contradicts the IT lobby.

Unemployment rates are high for information systems graduates, with 14.7 percent out of work.

The competition from foreign workers also depresses wages for Americans. The average hourly wage for computer and mathematics graduates was $37.27 in 2000, and $39.24 in 2011 — an average rise of less than 0.5 percent per year.

And research from the Economic Policy Institute contends that only half of American students who graduate with a degree in science; technology, engineering or maths ends up with a job in that field.

According to a paper by Professor Hal Salzman and other researchers, a third to half of new IT jobs go to foreign workers rather than graduates.

Based on figures from the State Department, the Department of Homeland Security and Current Population Survey data, they estimate that 160,755 foreign workers were given H-1B or other work visas for IT jobs in 2011, out of 483,692 jobs that went to candidates with a bachelor’s or master’s degree.

“It has nothing to do with any lack of American workers,” Professor Hira said. “It is simply that the foreign workers will work for less.”

Neither Mark Zuckerberg nor FWD.us responded to GlobalPost’s requests for comment.

I have less faith on my army that you have on yours, Sharif told Manmohan Singh in New York

 

In a sensational disclosure kept under wraps so far by Prime Minister Manmohan Singh, his Pakistani counterpart Nawaz Sharif said he had less faith in the Pakistan Army than India when the two met in New York last month on the sidelines of UN General Assembly.

The remark was not in jest but came in the course of an intense discussion between the two premiers during their one-hour meeting on September 29. Sharif’s remarks were reported in a ‘Record of Discussion’ (RoD) made by the prime minister’s aides and compiled by the Prime Minister’s Office to be shared with top government functionaries of the Indian government.

Mail Today has accessed this document. Sources say that discussions provide insights into the meeting of the prime ministers in the New York Palace Hotel’s fourth floor Stanford Room. The meeting happened amid a tense standoff, and Sharif repeatedly tried hard to push for dialogue between the foreign offices of the two countries first before involving the Pakistan Army in resolving the standoff on the Line of Control.

The revelation comes on a day when the tensions between the two countries have escalated; a Junior Commissioned Officer (JCO) was killed on October 28 during a cease-fire violation by Pakistan in the Uri sector of north Kashmir. The firing took place on the wee hours of Monday when troops of the Indian Army’s 8 Kumaon regiment were patrolling along the LoC in Uri sector, 120 km northwest of Srinagar.

An Army official said that an area domination patrol party came under firing from the Pakistan side after midnight at 12.15 am on Monday leading to the death of the JCO, Prakash Chander, of Pithoragarh, Uttarakhand.

Officials said the Army didn’t retaliate but lodged a protest with the Pakistani Army over a hotline.

Violation

It is apparent, however, that Pakistani assurances are not translating into action. On Saturday, India had slammed Pakistan for claiming that it had not been given adequate evidence on the 26/11 attacks, where Islamabad is yet to bring the perpetrators of the 2008 attacks to justice.

The ceasefire violation took place at Bhim post near Kaman Bridge, the place where the Srinagar-Muzaffarabad bus crosses the LoC. Last week, a BSF soldier was killed and six others wounded after Pakistani troops fired at 50 Indian posts along the International Border in Jammu.

There has been a steep rise in cease-fire violations along the LoC and the International Border in Jammu and Kashmir in past few weeks. Officials say over 135 ceasefire violations have been reported in 2013, the highest in the last eight years.

At the New York meeting, the conversation began with Sharif clearing the air on the dehati aurat controversy that had broken out earlier in the day. The RoD notes that Sharif pushed for talks led by the foreign office but Singh stuck to his guns that the talks cannot be held between the civilian officials.

Sharif again revised his proposal and suggested that talks can be at the level of the Director General of Military Operations and the Foreign Office, which was also declined by Singh.

It was then that the Indian Prime Minister repeated his assertion that those who have caused the incidents on the Line of Control and the International Border will have to resolve it, and that militaries both countries should be involved. It was then Sharif signed off with the remark reposing mistrust in his own army, telling Singh that India had more faith in their capabilities than he did.

The remark is significant because it revealed that Sharif continues to struggle with a powerful army at home. It is also a reassertion that India will have to deal with multiple power centres in Pakistan, even more significant in the present context when the pressure is on Sharif to give a powerful postretirement role to his hard-line Army Chief General Ashfaq Kayani, who wants to handle the Kashmir and Afghanistan affairs as National Security Advisor and control Sharif’s foreign and strategic policy. Sharif also raised the issue of Baluchistan to which Manmohan responded that no evidence has been handed over by Pakistan on this accusation which has been leveled earlier as well.

Response

Last week on his way back from the summit meetings in Russia and China, Manmohan expressed his disappointment at the happenings on the LoC. “Let me say that I am disappointed, because in the New York meeting, there was a general agreement on both the sides that peace and tranquillity should be maintained on the border, on the Line of Control as well as on the international border and this has not happened.”

Nawaz’s statement exposes the fissures in the Pakistan establishment, but it also brings to the fore Nawaz’s Janus faced approach as he is neither willing nor capable of reining in the army, but he is willing to run down his own army to showcase to the international community that he holds the reins of power in Pakistan.

The Gujrat Riots (Massacre)

 

Historian scholars have described it as a Pogrom, ethnic cleansing, state terrorism, and meeting the

“legal definition of genocide”.

What happened was that Hindu groups set a train on fire inbound from Pakistan killing everyone then blamed it on Muslims in Pakistan. This false flag was used as a pretext to start riots which were a disguise to carry out their preplanned attack on the Muslim minority living in the state of Gujrat, India. The minister (Modi), police, media, and the hindu residents were all in on it. The Muslim males (men and children) were killed brutally, their houses destroyed and burned, while their women and girls raped. This continued for three days. Afterwards a kangaroo court trial was run against those involved and they were released without a single charge.
