Islamabad: The three member judicial commission to probe the Bhoja Air Crash includes two former PCO judges.
The commission includes Justice (retd) Zahid Hussain, Justice (retd) Nadeem Sikandar and former federal Secretary Waseem Kausar.
The judges were removed from the office after the 31st July 2009 verdict, which declared the 3rd November 2007 actions of Musharraf as illegal and removed the judges, who took oath under the PCO issued by Pervez Musharraf in 2007.
Talking to Saach.TV, Athar Minallah, a very prominent Supreme Court Lawyer and leader of judges movement disclosed the legalities of the commission and told that the commission can not be called judicial as the Chief Justice has not been consulted in the matter, which is a prerequisite for a judicial commission.
He further went on to say that the 31st July 2009 verdict clearly says that the judges who took oak under 2007 PCO were no longer and were never judges. He said that this team can be called as a ‘probe team’ but not a judicial commission.
He was very skeptical of the intentions of the government and expressed his concern that the government is trying to hide the truth and cover things up by forming this sort of investigation team. He said, “If government is so sincere in bringing the truth out then why doesn’t it go through the proper channel and ask Chief Justice to form a commission?”
Senator Mushahid Ullah, Secretary Information PML-N, while talking to Saach.TV presented his reservations over the commission and also questioned the appetite of government to enact the orders passed by judiciary. He said that government is not adhering to the orders of Supreme Court then how can one expect it to follow any other investigation.
He blamed the nepotism and maladministration of the government in the matter. He disclosed that the new Director General Civil Aviation Authority (CAA) Nadeem Yousufzai is a close aide of President Zardari and is a very incompetent person.
Official investigations for probing the Bhoja crash have not been started effectively yet and they have struck the first heavy road bump so early. Analysts are also of the view that such action from the government could be another step towards prolonging the investigation and saving its cronies.
