Conflict & Justice Why India’s minister of women thinks we need to accept marital rape

NEW DELHI, India — One in every four Indians is illiterate, and one out of every five lives below the poverty line. Many in the country are deeply religious.

These qualities turn ominous when they make it easier to get away with raping a woman in her own home.

While laws on domestic violence and rape exist in India, rape in the domestic sphere remains unacknowledged. India is one of the few countries in the world that have yet to criminalize marital rape, despite studies and statistics that show a terrifyingly high incidence. Earlier this month, the explanation for this oversight came from an unexpected source.

“The concept of marital rape, as understood internationally, cannot be suitably applied in the Indian context,” said Maneka Gandhi, the minister for women and child development, in response to a question posed to her in Parliament, “due to the level of illiteracy, poverty, myriad social customs and values, religious beliefs, mindset of the society to treat the marriage as a sacrament, etc.”  

 

Gandhi could not be reached this week to clarify what she meant.

But she was repeating, word for word, the Indian home minister’s answer to a similar question last April. The government officials seem to be saying that too many Indians aren’t ready to believe rape can happen within a marriage. Critics consider that idea laughable.

“The illiteracy and poverty arguments are foolish. Doctors face violence, judges face violence, lawyers face violence,” said Monika Joshi, a legal consultant with Maitri, an NGO that works with vulnerable women including victims of domestic violence. “[Former chairman of the Intergovernmental Panel on Climate Change] R. K. Pachauri sexually harassed an employee, isn’t he educated?”

Mallarika Sinha Roy, a professor of women’s studies at the Jawaharlal Nehru University, pointed out that given the high frequency of marital rape found by multiple studies in India, it is unlikely that the crime is limited by economic status.

“Illiteracy and poverty being cited as rationalization [to not criminalize marital rape] will not hold to reason, because many people belonging to those sections are more vulnerable to rape,” said Roy. “Poverty has nothing to do with people’s level of understanding of sexual violence, particularly women who actually every day show incredible substance and acumen in surviving.”

And if the government’s citation of India’s social customs and values refers to a higher moral standard that would somehow prevent marital rape, social workers find that the reverse is more likely. According to Joshi, who is also a social worker, customs that teach both boys and girls that consent isn’t relevant in a marriage have in fact forced women to accept marital rape as a norm.

“Women never use the word ‘rape’ when they talk about their husbands. They say ‘he was forceful and I didn’t like it, but I just lay there because I did not want to be beaten,’” said Joshi.

The social values that expect women to provide sex after marriage also expect them to abstain from sex before. India’s controversial and recently outlawedtwo-finger test” was, before 2014, an accepted test of a rape victim’s habituation to sex. Some have interpreted the government’s citation of “values” as a reference to the difficulty of proving rape against a married, sexually active woman.

Indira Jaising, a prominent human rights lawyer at the Indian Supreme Court, pointed out that these moral standards on premarital sex cannot apply under judicial consideration.

“Courts are accustomed to dealing with rape of sexually active women in the case of a stranger perpetrating the rape, so why should there be a problem with married women?” she said. 

While sex is considered a spouse’s right in India — denying it is grounds for divorce — it’s not one that trumps a woman’s rights over her own body, Jaising said. The ministry’s reference to “religious beliefs” making marital rape impossible therefore rings hollow.

“The constitution does not visualize a situation where two rights conflict, there is always a way of giving full effect to both rights. There can be no conflict between the right to practice religion and the right to bodily autonomy for a woman, they must coexist. No religion sanctions rape, be it of your own wife.”

Yet acknowledging marital rape is considered a threat to the very concept of marriage, considered a “sacrament” in India. Joshi, however, insists that criminalizing marital rape will only strengthen the institution.

“When we teach people that respect and equality is important, that marriage is trust, it will strengthen the institution of marriage, not break it,” she said.

Arab Leaders and Aleppo- Insanity Overtakes Humanity

Does Authoritarian Insanity have another Name?

Authoritarian leaders kill people just as butcher slaughters cattle. Casual allusion and changing power metaphors hardly distinguish between people and animals across the Arab world.  The cycle of the dreadful humanitarian crisis unfolding in Aleppo is baffling – as if global humanity and institutions do not exist for other than Americans and Europeans. All advancements of knowledge-based humanity, laws and preservation of life and human dignity and international institutions appear null and void. Our failure to grasp the compelling realities of authoritarian atrocities against the helpless civilians makes us feel we are standing at one of the darkest timelines of history.Is the surrender of Aleppo to powerful insanity inevitable?  Given the informed and resourceful 21st century global community, we were capable to avert the bombardment and to extend security and sense of humanity to the besieged population. Yet, the UNO Security Council and US-Russia kept on talking and talking about paper resolution, abstract dialogue and no concrete action to preserve human dignity and freedom. The abyss of horrors unfolding tells of the deliberate rapes of women and execution of the civilian population by the Assad forces as stated by the outgoing UN SG Ban-Ki Moon. The fallen Aleppo brings shame and disgrace to all the Arab leaders and the global humanity for being indifferent to the ever growing humanitarian crisis.  

Where are the Muslim scholars and intellectuals to claim sense of honesty about what is happening on the ground? If values of human life and wisdom were the signs of intelligence and responsibility, the situation warranted an urgent powerful intervention to safeguard the entrenched people of Aleppo. Witnessing the authoritarian cruelty, bombardment and the on-going cold blooded massacres of innocent civilians in Aleppo, the conscientious Arab masses wonder if there are any Arab leaders to offer sense of security to the people.  Shocking as it is to discover that there are no Arab leaders to protect the people in conflict situations. They are foreign agents of influence imposed on the helpless Arabian people.

The entrenched people kept on calling upon global humanity to come to rescue them but it was an illusion turned fantasy and nothing else. The global humanity, the UNO, America and humanitarian protection laws are just empty words devoid of life, morality and just written in school books with dry ink that means nothing to the suffering humanity in Aleppo.  Today, Shamy, a 15 year old girl from Aleppo sending SOS on Twitter as if there is a living global mankind listening to her in extreme adversity.  Abdullah, a 72 year old man carried his seventy year old wounded wife on a wooden cart and was waiting for medical help but shell fell and an Al-Jazeera reporter showed the clips how she died there in split second, but Abdullah kept on moving with the dead body in search of the unknown.

London-based Al-Jazeera moderator asked 15 year old school girl Aminah Abubaker, if she was safe and had enough food. She answered, “For two weeks we are hiding in the basement watching deaths and destruction and nowhere to go and no food and no shops around here. Is this catastrophic humanitarian crisis out of the nowhere? The inhuman political metaphor is sugarcoated by Syria’s enriched neighbors –  a treacherous cluster of petro-dollar economic prosperity to furbish modernism that prevails in palaces, not amongst the masses.

While Steffan de Mustara, Kerry and Larove pretend to be talking about a ceasefire and safe corridor to allow humanitarian aid and the civilians to depart from the bombardment in Aleppo, it was all a malicious stage drama to cover-up the political failure.    For five years, millions are forcibly displaced to become unwelcomed refugees in European continents, several millions killed and others waiting to be consumed by the insanity of the Assad regime and its military allies. Are these official honest and rational or do they think the global mankind is blind. The game is the same “do nothing” and talk loud. In a global age of knowledge and information, Arab leaders cannot pretend being ignorant and unaware of the catastrophic humanitarian crisis unfolding daily on the television screen. The alleged war crimes are just a scenario for the uncertain future, but reality warranted swift action to safeguard the human lives entrapped in the war zones, and honor of Muslims and their habitats across Aleppo, Idlib, Baghdad, Mosul and Yemen. None of the puppets had courage and will to challenge the deliberate pillage and insanity imposed by the Assad forces and the superpowers. Are there no Arab Generals and no Arab armies to help the believers?  If not, why do these leaders spent billions of dollars to acquire weapons from the US and Europeans? How could the rest of the Arab leaders differentiate between their role and what is being carried out by the Assad regime? Are they all sadistic criminals and violent robbers of peoples’ right, human dignity and future? Isn’t the same insane egoism and militarism that brought downfall of Saddam Hussein, Ghaddafi and many others in the region?

All Arab leaders must be held accountable for the crimes committed against the Syrian people. To uplift their own images, when overwhelming crimes against humanity are shown by the global news media, some affluent Arab leaders take asylum in the shadow of British dwindling leadership at a gathering in Bahrain and others sent foreign ministers to Paris to mourn their own wishful thinking for failure to oust the Syrian dictator Bashar al-Assad. Often Arab leaders say next to nothing to global audience. But one of the foreign ministers spoke of Islamic extremism emerging out of Aleppo if nothing was done.  The cynical minds know nothing about the realities on the ground. Who will do what to safeguard the besieged people of Aleppo for over several years, is not clear. It is the ruthless forces of Syrian Government and its military Allies Russia, Iran and Shiite army of Hezbollah that are fighting against the civilian population opposing the regime of Bashar Al-Assad. Ironically America, Britain and France had already destabilized the entire Arab region by continuous aerial bombardment and deaths and destruction to which the frontline Arab countries were an essential component. None of the Arab leaders had any imagination or capacity on how to deal with political problems and approach conflict management and security paradigm. It is always the Master – USA and Britain that dictate the oil exporting Arab states in their affairs. All of the secretive police apparatus are operated by the same egomaniac masters. It is unthinkable to imagine that Bashar Al-Assad  and his allies could ever escape the accountability by time and history.

Are the Arab Rulers Waiting to See the End Game?

Sigmund Freud (Civilization and its Discontent, 1930) noted that “the inclination to aggression is an original self-subsisting instinctual disposition in man, and that it constitutes the greatest impediment to civilization.”  The Arab Middle East is no exception.  In view of the unstoppable cycle of political killings and daily bloodbaths across Syria, Iraq, Egypt, Libya, Yemen, and spill-over to other oil producing Arab nations – and reactionary militancy against the authoritarian rule and dismantling of the socio-economic infrastructures –  is the Arab world coming to its own end because of the sadistic dictators?  The Arab rulers and the masses live and breathe in conflicting time zones being unable to see the rationality of people-oriented governance. Perhaps, the worst is yet to come, surrender to foreign forces as there are no leaders to think of the future or the Arab armies to defend the people. Borrowed weapons and corrupt and failed rulers cannot extend moral or intellectual security to the masses. The question is how to decode treachery, greed, incompetence and dead conscience to tell the future generation – the real story of the Arab ruler’s aggressiveness and drudgery interjected and internalized in egoistic conscience to manage the governance.

Wars suck out positive human thinking and creative energies to articulate a sustainable future.How should humanity view contemporary Arab societies, their war-torn bloody cultures operated by foreign mercenaries and few authoritarian dictators?  What kind of message of civility, moral and intellectual values do they convey to the watchful eyes of the global community? What happened to their Islamic culture, values and glorious civilization? Was the petrodollar a conspiracy (“fitna”) to disconnect the Arab people from Islamic culture and civilization? Contemporary global affairs warrant intelligent and competent leadership not kings, not military dictators or dull princes occupying splendid palaces away from the people. Leaders manage the crisis when facts of life warrant change and adaptability to the future. Often crisis unity people of reason but not the Arab rulers.

The Syrian war will end as it cannot go for ever. Its ripple effects will haunt present and future generations. The people’s struggle could soon move to other neighboring Arab societies encouraging masses to rise against the authoritarian regimes for people-oriented Islamic governance. The super powers and Iran appear to be on the wrong side of time and history. If Iranian had Islamic consciousness and unity of the Ummah (nation) as its policy aim, it was immaterial whether Assad remains in power or not. Professing sectarian shiisim and taking sides with monsters of history and talking about Muslim unity make no sense by the Iranian speaker of the Majlis. They all breathe in self-geared illusions of wishful thinking. While the concerned mankind is shocked by the atrocities and horrors carried out by the Assad regime and Russians, ironically in West Aleppo others are celebrating the victory of insanity over the humanity. History speaks its own language that all those leaders and nations claiming to be most powerful on the planet were destroyed by their own designs and wicked strategies. Those dictators and political monsters that willfully brutalized the humanity should not go unchallenged for their crimes and accountability.

Yet there are men who take (for worship) others besides Allah, as equal (with Allah.: They love them as they should love Allah.But those of Faith are overflowing in their love for Allah.If only the unrighteous could see, behold, they would see the penalty: that to Allah belongs all power, and Allah will strongly enforce the penalty. (Surah Al-Baqara, 165)

Say: “O People of the Book! come to common terms as between us and you: That we worship none but Allah.that we associate no partners with him; that we erect not, from among ourselves, Lords and patrons other than Allah.” If then they turn back, say ye: “Bear witness that we (at least) are Muslims (bowing to Allah.s Will). Allah forgiveth not that partners should be set up with Him; but He forgiveth anything else, to whom He pleaseth; to set up partners with Allah is to devise a sin Most heinous indeed. (Surah An-Nisa’, 48)

Allah forgiveth not (The sin of) joining other gods with Him; but He forgiveth whom He pleaseth other sins than this: one who joins other gods with Allah, Hath strayed far, far away (from the right). (Surah An-Nisa’, 116)

They do blaspheme who say: “(Allah) is Christ the son of Mary.” But said Christ: “O Children of Israel! worship Allah, my Lord and your Lord.” Whoever joins other gods with Allah,- Allah will forbid him the garden, and the Fire will be his abode.There will for the wrong-doers be no one to help. (Surah Al-Ma’ida, 72)

Say: “What thing is most weighty in evidence?” Say: “(Allah) is witness between me and you; This Qur’an hath been revealed to me by inspiration, that I may warn you and all whom it reaches.Can ye possibly bear witness that besides Allah there is another Allah.” Say: “Nay! I cannot bear witness!” Say: “But in truth He is the one Allah, and I truly am innocent of (your blasphemy of) joining others with Him.” (Surah Al-An‘am, 19)

“Nay,- On Him would ye call, and if it be His will, He would remove (the distress) which occasioned your call upon Him, and ye would forget (the false gods) which ye join with Him!” (Surah Al-An‘am, 41)

When he saw the sun rising in splendour, he said: “This is my Lord; this is the greatest (of all).” But when the sun set, he said: “O my people! I am indeed free from your (guilt) of giving partners to Allah. (Surah Al-An‘am, 78)

“How should I fear (the beings) ye associate with Allah, when ye fear not to give partners to Allah without any warrant having been given to you? Which of (us) two parties hath more right to security? (tell me) if ye know. (Surah Al-An‘am, 81)

This is the guidance of Allah.He giveth that guidance to whom He pleaseth, of His worshippers.If they were to join other gods with Him, all that they did would be vain for them. (Surah Al-An‘am, 88)

“And behold! ye come to us bare and alone as We created you for the first time: ye have left behind you all (the favours) which We bestowed on you: We see not with you your intercessors whom ye thought to be partners in your affairs: so now all relations between you have been cut off, and your (pet) fancies have left you in the lurch!(Surah Al-An‘am, 94)

Yet they make the Jinns equals with Allah, though Allah did create the Jinns; and they falsely, having no knowledge, attribute to Him sons and daughters.Praise and glory be to Him! (for He is) above what they attribute to Him! (Surah Al-An‘am, 100)

If it had been Allah.s plan, they would not have taken false gods: but We made thee not one to watch over their doings, nor art thou set over them to dispose of their affairs. (Surah Al-An‘am, 107)

Out of what Allah hath produced in abundance in tilth and in cattle, they assigned Him a share: they say, according to their fancies: “This is for Allah, and this” – for our “partners”! but the share of their” partners “reacheth not Allah, whilst the share of Allah reacheth their “partners” ! evil (and unjust) is their assignment! (Surah Al-An‘am, 136)

Even so, in the eyes of most of the pagans, their “partners” made alluring the slaughter of their children, in order to lead them to their own destruction, and cause confusion in their religion.If Allah had willed, they would not have done so: But leave alone them and their inventions. (Surah Al-An‘am, 137)

Those who give partners (to Allah.will say: “If Allah had wished, we should not have given partners to Him nor would our fathers; nor should we have had any taboos.” So did their ancestors argue falsely, until they tasted of Our wrath.Say: “Have ye any (certain) knowledge? If so, produce it before us.Ye follow nothing but conjecture: ye do nothing but lie.” (Surah Al-An‘am, 148)

Say: “Come, I will rehearse what Allah hath (really) prohibited you from”: Join not anything as equal with Him; be good to your parents; kill not your children on a plea of want;- We provide sustenance for you and for them;- come not nigh to shameful deeds.Whether open or secret; take not life, which Allah hath made sacred, except by way of justice and law: thus doth He command you, that ye may learn wisdom. (Surah Al-An‘am, 151)

Say: “Truly, my prayer and my service of sacrifice, my life and my death, are (all) for Allah, the Cherisher of the Worlds: (Surah Al-An‘am, 162)

No partner hath He: this am I commanded, and I am the first of those who bow to His will. (Surah Al-An‘am, 163)

Say: the things that my Lord hath indeed forbidden are: shameful deeds, whether open or secret; sins and trespasses against truth or reason; assigning of partners to Allah, for which He hath given no authority; and saying things about Allah of which ye have no knowledge. (Surah Al-A‘raf, 33)

Or lest ye should say: “Our fathers before us may have taken false gods, but we are (their) descendants after them: wilt Thou then destroy us because of the deeds of men who were futile?” (Surah Al-A‘raf, 173)

But when He giveth them a goodly child, they ascribe to others a share in the gift they have received: but Allah is exalted high above the partners they ascribe to Him. (Surah Al-A‘raf, 190)

Do they indeed ascribe to Him as partners things that can create nothing, but are themselves created? (Surah Al-A‘raf, 191)

Have they feet to walk with? Or hands to lay hold with? Or eyes to see with? Or ears to hear with? Say: “Call your ‘god-partners’, scheme (your worst) against me, and give me no respite! (Surah Al-A‘raf, 195)

They take their priests and their anchorites to be their lords in derogation of Allah, and (they take as their Lord) Christ the son of Mary; yet they were commanded to worship but One Allah.there is no god but He.Praise and glory to Him: (Far is He) from having the partners they associate (with Him). (Surah At-Tawba, 31)

They serve, besides Allah, things that hurt them not nor profit them, and they say: “These are our intercessors with Allah.” Say: “Do ye indeed inform Allah of something He knows not, in the heavens or on earth?- Glory to Him! and far is He above the partners they ascribe (to Him)!” (Surah Yunus, 18)

Relate to them the story of Noah.Behold! he said to his people: “O my people, if it be hard on your (mind) that I should stay (with you) and commemorate the signs of Allah,- yet I put my trust in Allah.Get ye then an agreement about your plan and among your partners, so your plan be on to you dark and dubious.Then pass your sentence on me, and give me no respite. (Surah Yunus, 71)

“And I follow the ways of my fathers,- Abraham, Isaac, and Jacob; and never could we attribute any partners whatever to Allah.that (comes) of the grace of Allah to us and to mankind: yet most men are not grateful. (Surah Yusuf, 38)

And most of them believe not in Allah without associating (other as partners) with Him! (Surah Yusuf, 106)

Say: “Who is the Lord and Sustainer of the heavens and the earth?” Say: “(It is) Allah.” Say: “Do ye then take (for worship) protectors other than Him, such as have no power either for good or for harm to themselves?” Say: “Are the blind equal with those who see? Or the depths of darkness equal with light?” Or do they assign to Allah partners who have created (anything) as He has created, so that the creation seemed to them similar? Say: “(Allah) is the Creator of all things: He is the One, the Supreme and Irresistible.” (Surah Ar-Ra‘d, 16)

Is then He who standeth over every soul (and knoweth) all that it doth, (like any others)? And yet they ascribe partners to Allah.Say: “But name them! is it that ye will inform Him of something he knoweth not on earth, or is it (just) a show of words?” Nay! to those who believe not, their pretence seems pleasing, but they are kept back (thereby) from the path.And those whom Allah leaves to stray, no one can guide. (Surah Ar-Ra‘d, 33)

Those to whom We have given the Book rejoice at what hath been revealed unto thee: but there are among the clans those who reject a part thereof.Say: “I am commanded to worship Allah, and not to join partners with Him.Unto Him do I call, and unto Him is my return.” (Surah Ar-Ra‘d, 36)

And Satan will say when the matter is decided: “It was Allah Who gave you a promise of Truth: I too promised, but I failed in my promise to you.I had no authority over you except to call you but ye listened to me: then reproach not me, but reproach your own souls.I cannot listen to your cries, nor can ye listen to mine.I reject your former act in associating me with Allah.For wrong-doers there must be a grievous penalty.” (Surah İbrahim, 22)

(Inevitable) cometh (to pass) the Command of Allah.seek ye not then to hasten it: Glory to Him, and far is He above having the partners they ascribe unto Him! (Surah An-Nahl, 1)

He doth send down His angels with inspiration of His Command, to such of His servants as He pleaseth, (saying): “Warn (Man) that there is no god but I: so do your duty unto Me.” (Surah An-Nahl, 2)

He has created the heavens and the earth for just ends: Far is He above having the partners they ascribe to Him! (Surah An-Nahl, 3)

Then, on the Day of Judgment, He will cover them with shame, and say: “Where are My ‘partners’ concerning whom ye used to dispute (with the godly)?” Those endued with knowledge will say: “This Day, indeed, are the Unbelievers covered with shame and misery,- (Surah An-Nahl, 27)

Yet, when He removes the distress from you, behold! some of you turn to other gods to join with their Lord- (Surah An-Nahl, 54)

His authority is over those only, who take him as patron and who join partners with Allah. (Surah An-Nahl, 100)

Say: “(Allah) knows best how long they stayed: with Him is (the knowledge of) the secrets of the heavens and the earth: how clearly He sees, how finely He hears (everything)! They have no protector other than Him; nor does He share His Command with any person whatsoever. (Surah Al-Kahf, 26)

“But (I think) for my part that He is Allah, My Lord, and none shall I associate with my Lord. (Surah Al-Kahf, 38)

So his fruits (and enjoyment) were encompassed (with ruin), and he remained twisting and turning his hands over what he had spent on his property, which had (now) tumbled to pieces to its very foundations, and he could only say, “Woe is me! Would I had never ascribed partners to my Lord and Cherisher!” (Surah Al-Kahf, 42)

One Day He will say, “Call on those whom ye thought to be My partners,” and they will call on them, but they will not listen to them; and We shall make for them a place of common perdition. (Surah Al-Kahf, 52)

Say: “I am but a man like yourselves, (but) the inspiration has come to me, that your Allah is one Allah.whoever expects to meet his Lord, let him work righteousness, and, in the worship of his Lord, admit no one as partner. (Surah Al-Kahf, 110)

Behold! We gave the site, to Abraham, of the (Sacred) House, (saying): “Associate not anything (in worship) with Me; and sanctify My House for those who compass it round, or stand up, or bow, or prostrate themselves (therein in prayer). (Surah Al-Hajj, 26)

Being true in faith to Allah, and never assigning partners to Him: if anyone assigns partners to Allah, is as if he had fallen from heaven and been snatched up by birds, or the wind had swooped (like a bird on its prey) and thrown him into a far- distant place. (Surah Al-Hajj, 31)

Those who join not (in worship) partners with their Lord; (Surah Al-Muminun, 59)

He knows what is hidden and what is open: too high is He for the partners they attribute to Him! (Surah Al-Muminun, 92)

Allah has promised, to those among you who believe and work righteous deeds, that He will, of a surety, grant them in the land, inheritance (of power), as He granted it to those before them; that He will establish in authority their religion – the one which He has chosen for them; and that He will change (their state), after the fear in which they (lived), to one of security and peace: ‘They will worship Me (alone) and not associate aught with Me.’If any do reject Faith after this, they are rebellious and wicked. (Surah An-Nur, 55)

Say: Praise be to Allah, and Peace on his servants whom He has chosen (for his Message). (Who) is better?- Allah or the false gods they associate (with Him)? (Surah An-Naml, 59)

Or, Who guides you through the depths of darkness on land and sea, and Who sends the winds as heralds of glad tidings, going before His Mercy? (Can there be another) god besides Allah.- High is Allah above what they associate with Him! (Surah An-Naml, 63)

That Day ((Allah)) will call to them, and say “Where are my ‘partners’?- whom ye imagined (to be such)?” (Surah Al-Qasas, 62)

It will be said (to them): “Call upon your ‘partners’ (for help)” :they will call upon them, but they will not listen to them; and they will see the Penalty (before them); (how they will wish) ‘if only they had been open to guidance!’ (Surah Al-Qasas, 64)

Thy Lord does create and choose as He pleases: no choice have they (in the matter): Glory to Allah. and far is He above the partners they ascribe (to Him)! (Surah Al-Qasas, 68)

The Day that He will call on them, He will say: “Where are my ‘partners’? whom ye imagined (to be such)?” (Surah Al-Qasas, 74)

We have enjoined on man kindness to parents: but if they (either of them) strive (to force) thee to join with Me (in worship) anything of which thou hast no knowledge, obey them not. Ye have (all) to return to me, and I will tell you (the truth) of all that ye did. (Surah Al-‘Ankabut, 8)

Now, if they embark on a boat, they call on Allah, making their devotion sincerely (and exclusively) to Him; but when He has delivered them safely to (dry) land, behold, they give a share (of their worship to others)!- (Surah Al-‘Ankabut, 65)

No intercessor will they have among their “Partners” and they will (themselves) reject their “Partners”. (Surah Ar-Rum, 13)

He does propound to you a similitude from your own (experience): do ye have partners among those whom your right hands possess, to share as equals in the wealth We have bestowed on you? Do ye fear them as ye fear each other? Thus do we explain the Signs in detail to a people that understand. (Surah Ar-Rum, 28)

When trouble touches men, they cry to their Lord, turning back to Him in repentance: but when He gives them a taste of Mercy as from Himself, behold, some of them pay part-worship to other god’s besides their Lord,- (Surah Ar-Rum, 33)

Or have We sent down authority to them, which points out to them the things to which they pay part-worship? (Surah Ar-Rum, 35)

It is Allah Who has created you: further, He has provided for your sustenance; then He will cause you to die; and again He will give you life. Are there any of your (false) “Partners” who can do any single one of these things? Glory to Him! and high is He above the partners they attribute (to him)! (Surah Ar-Rum, 40)

Behold, Luqman said to his son by way of instruction: “O my son! join not in worship (others) with Allah. for false worship is indeed the highest wrong-doing.” (Surah Luqman, 13)

And We have enjoined on man (to be good) to his parents: in travail upon travail did his mother bear him, and in years twain was his weaning: (hear the command), “Show gratitude to Me and to thy parents: to Me is (thy final) Goal. (Surah Luqman, 14)

“But if they strive to make thee join in worship with Me things of which thou hast no knowledge, obey them not; yet bear them company in this life with justice (and consideration), and follow the way of those who turn to me (in love): in the end the return of you all is to Me, and I will tell you the truth (and meaning) of all that ye did.” (Surah Luqman, 15)

Say: “Call upon other (gods) whom ye fancy, besides Allah. They have no power,- not the weight of an atom,- in the heavens or on earth: No (sort of) share have they therein, nor is any of them a helper to Allah. (Surah Saba’, 22)

Say: “Show me those whom ye have joined with Him as partners: by no means (can ye). Nay, He is Allah, the Exalted in Power, the Wise.” (Surah Saba’, 27)

If ye invoke them, they will not listen to your call, and if they were to listen, they cannot answer your (prayer). On the Day of Judgment they will reject your “Partnership”. and none, (O man!) can tell thee (the Truth) like the One Who is acquainted with all things. (Surah Fatir, 14)

Say: “Have ye seen (these) ‘Partners’ of yours whom ye call upon besides Allah. Show Me what it is they have created in the (wide) earth. Or have they a share in the heavens? Or have We given them a Book from which they (can derive) clear (evidence)?- Nay, the wrong-doers promise each other nothing but delusions. (Surah Fatir, 40)

Allah puts forth a Parable a man belonging to many partners at variance with each other, and a man belonging entirely to one master: are those two equal in comparison? Praise be to Allah. but most of them have no knowledge. (Surah Az-Zumar, 29)

But it has already been revealed to thee,- as it was to those before thee,- “If thou wert to join (gods with Allah., truly fruitless will be thy work (in life), and thou wilt surely be in the ranks of those who lose (all spiritual good)”. (Surah Az-Zumar, 65)

(The answer will be:) “This is because, when Allah was invoked as the Only (object of worship), ye did reject Faith, but when partners were joined to Him, ye believed! the Command is with Allah, Most High, Most Great!” (Surah Ghafir, 12)

“Ye do call upon me to blaspheme against Allah, and to join with Him partners of whom I have no knowledge; and I call you to the Exalted in Power, Who forgives again and again!” (Surah Ghafir, 42)

Then shall it be said to them: “Where are the (deities) to which ye gave part- worship (Surah Ghafir, 73)

But when they saw Our Punishment, they said: “We believe in Allah,- the one Allah – and we reject the partners we used to join with Him.(Surah Ghafir, 84)

To Him is referred the Knowledge of the Hour (of Judgment: He knows all): No date-fruit comes out of its sheath, nor does a female conceive (within her womb) nor bring forth the Day that ((Allah)) will propound to them the (question), “Where are the partners (ye attributed to Me?” They will say, “We do assure thee not one of us can bear witness!” (Surah Fussilat, 47)

What! have they partners (in godhead), who have established for them some religion without the permission of Allah. Had it not been for the Decree of Judgment, the matter would have been decided between them (at once). But verily the Wrong- doers will have a grievous Penalty. (Surah Ash-Shura, 21)

Say: “Do ye see what it is ye invoke besides Allah. Show me what it is they have created on earth, or have they a share in the heavens bring me a book (revealed) before this, or any remnant of knowledge (ye may have), if ye are telling the truth! (Surah Al-Ahqaf, 4)

And make not another an object of worship with Allah. I am from Him a Warner to you, clear and open! (Surah Adh-Dhariyat, 51)

Allah is He, than Whom there is no other god;- the Sovereign, the Holy One, the Source of Peace (and Perfection), the Guardian of Faith, the Preserver of Safety, the Exalted in Might, the Irresistible, the Supreme: Glory to Allah. (High is He) above the partners they attribute to Him. (Surah Al-Hashr, 23)

O Prophet! When believing women come to thee to take the oath of fealty to thee, that they will not associate in worship any other thing whatever with Allah, that they will not steal, that they will not commit adultery (or fornication), that they will not kill their children, that they will not utter slander, intentionally forging falsehood, and that they will not disobey thee in any just matter,- then do thou receive their fealty, and pray to Allah for the forgiveness (of their sins): for Allah is Oft-Forgiving, Most Merciful. (Surah Al-Mumtahana, 12)

Or have they some “Partners” (in Allah.ead)? Then let them produce their “partners”, if they are truthful! (Surah Al-Qalam, 41)

‘It gives guidance to the Right, and we have believed therein: we shall not join (in worship) any (gods) with our Lord. (Surah Al-Jinn, 2)

Say: “I do no more than invoke my Lord, and I join not with Him any (false god).” (Surah Al-Jinn, 20)

Mosque Ibrahim Ibn Abdul Aziz Al-Ibrahim or Caracas Mosque is a mosque in the El Recreo district of Caracas. It is the second largest mosque in Latin America after the King Fahd Islamic Cultural Center in Buenos Aires. The construction of the mosque began in 1989 by Sheikh Ibrahim Bin Abdulaziz. The building was designed by architect Zuhe Fayez. The mosque occupies an area of 5000 m²; its minaret is 113 metres high (the highest in Latin America). The dome is 23 metres  high. Construction of the mosque was completed in 1993. The mosque can hold around 3500 worshipers.;

What started as a well-intentioned scheme to help students pursuing higher education in Pakistan has failed in many ways.

The Prime Minister’s Laptop Scheme (formerly CM’s laptop scheme) has now become a program that is being abused by most stakeholders, seriously impacting the intentions behind the entire scheme and uptake of education at higher levels.

We take a look at how much this scheme is been abused, and how it has affected the educational bottom line in Pakistan.

Students & PM Laptops Scheme

According to the promotional content that comes with the scheme, laptops were given through it are supposed to be used for educational purposes and are intended to help students in improving their studies.

The laptops were envisioned to “bring a paradigm shift in the current education and research culture in the country”.

Only students that score good grades and are just starting their higher education can apply for a laptop through the scheme.

As mentioned earlier, students need to apply themselves in order to get laptops through this scheme. They need to create a profile and the application needs to be approved by the university. Following that, the student is selected or refused based on their CGPA.

However, even though students get these laptops for their studies (the sole purpose of the scheme), it has been observed that many of them sell their laptops as soon as they get them.

Which begs the question, “Why to get the laptop at all?”

Laptops on Sale

According to the terms and conditions of the scheme, the receiver of a laptop is not allowed to sell any of the gifted assets. The image below is from the online form a student fills and accepts before applying for a laptop.

A brief search on OLX shows several laptops from the PM’s Laptop Scheme on sale. Take a look at some of them below:

As you can see, most laptops are being sold for between Rs. 20,000 to Rs. 30,000. A little bargaining can reduce the price by up 2-3K according to some users.

Head over to Hafeez Centre, Dubai Plaza or PakGamers and you will see several more laptops from PM’s scheme on sale.

Putting aside reasons of commercial interest aside, the students are essentially violating the agreement that they entered into the day they got these laptops. They were never meant to be sold off for few thousands only.

By violating these contracts, students lose the right to call the government corrupt, no matter which political party they support.

Additionally, if students do not require these laptops, they should not apply to get one. By getting these laptops, they are depriving someone who actually needs them (but can’t afford it) of their legitimate right.

It also wastes the government’s efforts and money on non-deserving students. At the very least, these students should give these laptops to those who need them.

Simply getting one to sell is the equivalent of fraud.

PM’s Laptop Scheme Or A Vote Buying Scheme?

PM’s Laptop Scheme has often been criticized for being a front to buy out the youth by giving them free laptops.

Schemes like these also seem to be a gateway to make good headlines.

Why not offer students scholarships and discount their fees, the aspect which really matters to someone who is needy and is facing trouble in funding for his higher studies.

If someone is already scoring a high CGPA, does he/she really need a laptop or do they need support and better educational facilities to improve their capabilities?

Governments throughout the world encourage students with incentives. Usually, it is some sort of a scholarship which actually helps the student. Subsidizing university fees, funding for advanced and latest lab equipment should be the government’s focus if they want to uplift the educational standards of the country.

If the government really wants to promote education, it should offer scholarships to talented and needy students. More practical solutions can be explored.

Laptop Scheme & Corruption

To further add insult to injury, the laptops scheme has been plagued by corruption allegations since its inception. There have been reports on its corruption and mismanagement in the past as well.

Here are some of them:

Rs. 2 billion lost, in laptops scheme due to unknown reasons

Back in 2014, detailed report of Auditor General’s office revealed that laptop prices received sudden price hike from Rs. 20,000 to Rs. 37,950 without any change in specifications or hardware.

This caused a loss of Rs. 2 billion to the national exchequer due to “unknown” reasons. Another Rs. 2 billion were diverted from School Education Department to

Contractor given special favors, Rs. 1.6 billion paid before fulfillment of order

Furthermore, public officials managing the scheme gave “special” favors to the contractor, violating the contract in the process. On five occasions, a total of Rs. 1.6 billion was debited from the national treasury before receiving any of the ordered laptops.

Rs. 22 million paid in fake excise duty

Special Excise Duty is exempted on computer hardware including laptops. However, the contractor was paid Rs. 200 per laptop (1%) as excise duty without any reasons.

What’s more interesting is that due to the price hike, even if the excise duty was to be paid, it should have been Rs. 302. This alone caused a loss of Rs. 22 million.

Rs. 140 million not recovered from contractor

The government was due to collect advance income tax at a rate of 3.5% of the Rs.4.1 billion paid to the contractor. That tax of Rs. 140 million was never deducted or recovered from the contractor M/S Inbox.

Rs. 31 million not recovered as late delivery charges

According to the contract, late delivery of laptops would be fined at a rate of 2% in liquidated damages. However, 80,000 laptops were delivered late yet only Rs 14 million of the Rs 45 million were recovered.

Rs. 11 million lost due to irregular taxation

The Higher Education Department is exempt from paying any excise duty, advance tax or sales tax, yet Rs. 102 per laptop were paid to the contractor in the shape of “other taxes/duties” causing damages of Rs. 11 million.

Furthermore, the law prevents public universities from incurring any expenditure unless approved beforehand. Yet Rs. 1 million in distribution ceremonies and Rs. 28 million in distribution charges were incurred by certain institutions.

There have also been official reports of hundreds of laptops being allocated to students without considering the eligibility criteria.

More corruption revealed

Recently, another news story has popped up on several news agencies claiming that wide-scale irregularities have been witnessed in the laptop scheme yet again. Relatively newer phases of the scheme are yet to be investigated which might reveal similar news keeping the trend in the notice.

Final Words

The laptop scheme has its fair share of critics and admirers. However, the facts have been provided here to better inform readers about making their own conclusions regarding the PM Laptop Scheme.

In short, the students are violating their contracts and selling their laptops, the government isn’t focusing on education to practically improve the educational system, the laptops scheme fails in its envisioned aim of helping the needy and talented students,

Moreover with corruption scandals popping up regularly through the government’s accountant general’s official reports, perhaps the stakeholders need to go back to the drawing board and chart out a program that raises education standards all across the country in real essence.
